We at Oval Finance know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you consent that we will collect, use, and share your information in the ways described here. Your use of Oval Finance’s Services is at all times subject to our Terms of Use, which incorporates this Privacy Policy.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you access or use our Services, but not the practices of companies we do not own or control or people that we do not manage. We may gather various types of Personal Information from users and use it internally to personalize, provide, and improve the Services, fulfill requests, and analyze use. In certain cases, we may share some Personal Information with third parties only as described in this policy. If you are under the age of majority in your jurisdiction of residence, you may use the Services only with the consent of or under the supervision of your parent or legal guardian. The Services are not intended for children under 13 years of age.

Will Oval Finance ever change this Privacy Policy?

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will notify you by updating the date of this Privacy Policy and posting it on the Services. If required by law, we will also provide notice by e-mail or another manner through the Services. Modifications are effective upon posting unless otherwise indicated. What Information does Oval Finance Collect?

Information You Provide to Us: We receive and store information you knowingly provide, including information supplied when registering for a Custodial Account, making a digital currency transfer, using the Services, providing contact information such as an e-mail address, responding to surveys, reporting a problem, corresponding with us, or expressing marketing preferences. Information Collected from Other Sources: We may obtain information from third parties in connection with your use of our Services and combine it with information previously collected. Information Collected Automatically: When you interact with the Site, we may automatically receive and record information including IP address, geolocation data, device identification, cookie information, browser or device type, and requested pages or features, subject to your explicit agreement where required.

We typically collect automatically collected information through tracking technologies, including cookies, embedded scripts, web beacons, file information, and similar technology. Cookies are identifiers transferred to your browser or device that allow us to recognize it and tell us how and when pages and features are visited. You may change browser or device preferences to limit cookies, though this may prevent use of some features. We do not automatically collect Personal Information or other nonpublic information in connection with digital-currency network transactions conducted through the Platform or Website, and we do not use automatic tracking technologies in these parts of the Services unless you explicitly agree. We do not track users over time and across third-party websites to provide targeted advertising and therefore do not respond to Do Not Track requests.

Information we will never collect: We will never ask you to share your password to your Custodial Account or other security information that could be used to access your Custodial Account without your explicit consent and action.

How does Oval Finance Use the Personal Information it Receives?

As a general policy, we aim to protect your privacy and Personal Information by collecting, using, or sharing as little Personal Information as possible to provide the Services unless you explicitly agree in writing to additional collection, use, or sharing. We use Personal Information to provide and improve the Services, optimize technology, refine the user experience, and further our mission. This includes administering the Services; sending confirmations, technical notices, updates, security alerts, support and administrative messages; responding to comments and questions; analyzing how users use the Services; protecting against fraudulent, unauthorized, or illegal activity; linking information with consent; delivering requested products and services; and sharing information as disclosed in this policy.

Will Oval Finance Share Any of the Personal Information it Receives?

We do not share or sell Personal Information without your express consent except as described in this Privacy Policy. We may share Personal Information with your consent; affiliated businesses, including third-party websites such as Prime Trust, to the extent related to a transaction or service; agents that perform tasks on our behalf; potential acquirers or transferees in connection with a business transfer; and third-party services, such as Google Analytics, used to develop, improve, monitor, analyze, administer, and verify use of the Services. We may also access, read, preserve, and disclose information where we believe it is necessary to comply with law or court order, enforce our Terms of Use, or protect the rights, property, or safety of Oval Finance, employees, users, or others. When we share Personal Information, we do not share it in a manner that can identify you individually unless explicitly agreed by you, instructed by you, or legally required.

Is Personal Information about me secure?

We endeavor to protect the privacy of Personal Information in our records, but cannot guarantee complete security. The safety and security of your Personal Information also depend on you. Your Custodial Account is protected by your password, and we urge you to keep credentials safe and not leave your account open in an unsecured manner. We implement technological security measures including encryption, firewalls, and secure socket layer technology, and seek to protect Personal Information by refraining from collecting it where possible. These measures do not guarantee that Personal Information will not be accessed, disclosed, altered, or destroyed by a breach. By using the Services, you acknowledge and agree to assume these risks. We may use aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

EU RESIDENTS

If you are a resident of the European Economic Area (“EEA”) or Switzerland, you may have additional rights under the General Data Protection Regulation (“GDPR”) and other applicable laws with respect to your Personal Data. For this section, Personal Data generally means information that can individually identify a person, and processing generally covers collection, use, storage, and disclosure. Oval Finance is the controller of Personal Data processed in connection with the Services. If there is a conflict between this section and another provision of this Privacy Policy, the provision more protective of Personal Data controls to the extent of the conflict.

We collect Personal Data when you provide it directly to us, when third parties such as business partners or service providers provide it to us, or when it is automatically collected in connection with use of the Services. We process Personal Data to operate, improve, understand, and personalize the Services. Lawful bases include contractual necessity, legitimate interests, consent, legal obligations, protection of vital interests, and tasks carried out in the public interest. We share Personal Data with agents, third-party service providers, potential business partners in connection with business transfers, and for legal purposes, as described in this policy.

You have rights with respect to your Personal Data, including access, rectification, erasure, withdrawal of consent, portability, objection, restriction of processing, and the right to file a complaint with the supervisory authority of your country or European Union Member State. We retain Personal Data as long as necessary to provide Services and, where necessary, longer to comply with legal obligations, resolve disputes, collect owed fees, or as permitted by law. Certain Services are hosted and operated in part in the United States of America, and by using the Services and providing information, you authorize Oval Finance to transfer, store, and process Personal Data in the United States and possibly other countries, with reasonably necessary safeguards.

PRIVACY POLICY ADDENDUM FOR CALIFORNIA RESIDENTS

This Privacy Policy Addendum supplements the Privacy Policy and describes additional rights of residents of the State of California. Persons with disabilities may obtain this notice in an alternative format upon request by contacting us by email. California residents may request certain information concerning disclosure of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not share personal information with third parties for their own direct marketing purposes.

The California Consumer Privacy Act (“CCPA”) provides California residents with rights to receive disclosures regarding the collection, use, and sharing of Personal Information, as well as rights to know or access, delete, and limit sharing. The CCPA defines Personal Information as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly with a particular consumer or household. We collect identifiers such as name, phone number, contact address, e-mail address, social-media handles, credit card numbers as needed for requested Services, browsing history and interactions with Services, and audio or voice recordings where needed to provide Services. We may use these categories for compatible business or operational purposes and may share them with restricted service providers. We have not sold personal information.

California residents have the right to request access to Personal Information collected about them over the past 12 months, information regarding sources, collection purposes, and third parties or service providers with whom it is shared. They may request deletion of Personal Information collected directly from them in certain circumstances. To protect Personal Information, we are required to verify identity before acting on a request. You may submit a request to exercise rights to know, access, or delete Personal Information by email. Only you or an authorized agent may make a verifiable consumer request. We employ reasonable measures to detect fraudulent requests and prevent unauthorized access. You may make a verifiable consumer request twice within a 12-month period. We do not sell information to third parties and do not discriminate against anyone who chooses to exercise CCPA rights.
